Accessing records via the Mental Health Act

Accessing records via the Mental Health Act

You can apply to access your health records under the Mental Health Act 2014.

This is separate to the right to apply for access under the Freedom of Information Act (1992).

Section 248 of the MHA 2014

Under the Act, a person who is or was provided with treatment or care by a mental health service is entitled to inspect and be given a copy of any relevant document relating to part or all of their medical record. Some exemptions apply.

Making an application

There are no costs associated with this process.

Download the Request to Access Documents form.

Include proof of identification (driver's licence or passport).

Submit your application by:

Mail to Freedom of Information, GPO Box X2213, Perth WA 6847

Email to AKG.FOI@health.wa.gov.au

Handing it to a clinician who will forward it to the Health Information Officer.

Alternatively, a printed form can be mailed to you by contacting the FOI Office on 9224 7023.
